01Acceptance of terms
These Terms & Conditions ("Terms") govern your use of evfc.com, our products, and our services. By accessing the site, placing an order, or using MÖTEN evfc hardware or the eMÖTEN Charger Management System ("CMS"), you agree to these Terms. If you don't agree, don't use our products or services.
These Terms are entered into between you and EVFastCharge Ltd., a Delaware corporation doing business as "MÖTEN evfc" ("we," "us," "our").
02Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts in your jurisdiction. If you're using our products on behalf of a business, you represent that you have authority to bind that entity to these Terms.
03Products & services
We sell:
- EV charging hardware — Level 2 chargers, DC Fast Chargers, Battery Buffered cluster systems, pedestals, accessories.
- eMÖTEN Charger Management System (CMS) — software that operates connected chargers. Included free with every MÖTEN evfc charger; available standalone for OCPP-compliant third-party hardware.
- Installation as a Service — site assessment, electrical design, installation, commissioning.
- Support — technical assistance, warranty service, training.
Specifications, prices, and availability are subject to change. We do not guarantee that any product will remain available or that pricing will not change.
04Orders, pricing & payment
Order acceptance
Your order is an offer to purchase. We accept your offer only when we send an order confirmation or ship the goods. We may decline orders for any reason, including suspected fraud, unavailable inventory, or pricing errors.
Pricing
Prices on evfc.com (root) are in U.S. Dollars (USD) and do not include taxes, duties, shipping, or installation unless explicitly noted. Country sites (evfc.com/ca/, etc.) display localized pricing.
If we discover a material pricing error before shipment, we will contact you to confirm whether you wish to proceed at the corrected price or cancel for a full refund.
Payment
We accept the payment methods displayed at checkout. Payment is processed by our third-party payment processor; we do not store full payment card numbers on our servers. For project pricing (4+ chargers, Fleet 10+, Enterprise 25+), wire transfer and net-30 terms may be available subject to credit review.
Taxes
You are responsible for applicable sales, use, VAT, GST, customs duties, and import taxes. For deliveries within the United States, applicable sales tax is calculated and collected at checkout. For international orders, customs and import duties are the buyer's responsibility.

Risk of loss and title transfer to you upon delivery to the carrier (FOB Shipping Point) unless otherwise specified in a written project quote.

08eMÖTEN CMS terms
The eMÖTEN Charger Management System ("CMS") is licensed, not sold. Your use of the CMS is subject to these additional terms:
License grant
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the CMS to operate (a) MÖTEN evfc hardware you own or operate, or (b) OCPP-compliant third-party hardware under a standalone CMS subscription.
Free CMS with MÖTEN hardware
The CMS is included free of subscription fees on MÖTEN evfc chargers for as long as you own the charger. This applies to MÖTEN evfc hardware only and does not extend to third-party hardware or to operators who acquire used MÖTEN equipment through unauthorized channels.
Service availability
We aim for high uptime but do not guarantee uninterrupted CMS availability. Scheduled maintenance, force majeure, network outages, or third-party service failures may cause temporary unavailability. We are not liable for losses arising from CMS downtime, including loss of revenue from monetized charging sessions.
Restrictions
You may not (a) reverse-engineer, decompile, or extract source code of the CMS, (b) sublicense, rent, or resell access to the CMS without our written agreement, (c) use the CMS to facilitate illegal activity, (d) circumvent technical limits or security measures.
09Intellectual property
All content on evfc.com — including text, graphics, logos, photographs, software, and the design of the site — is owned by EVFastCharge Ltd. or its licensors and protected by U.S. and international copyright, trademark, and other intellectual property laws.
"MÖTEN," "evfc," "eMÖTEN," "XEYAR," and the MÖTEN evfc logo are trademarks of EVFastCharge Ltd. Other product and company names mentioned on the site are trademarks of their respective owners.
Patent applications for the XEYAR Battery Buffered architecture are pending in the United States and Canada.
10User conduct
You agree not to:
- Use our products or services in violation of any law or regulation
- Access or attempt to access systems or accounts you are not authorized to use
- Introduce viruses, malware, or other harmful code
- Scrape, crawl, or harvest data without permission
- Impersonate any person or misrepresent your affiliation
- Interfere with or disrupt the site, the CMS, or its underlying infrastructure
11Disclaimers
EXCEPT AS EXPRESSLY STATED IN OUR WARRANTY, PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that evfc.com or the CMS will be uninterrupted, error-free, or completely secure. EV charging is an evolving technology; while we engineer for reliability, real-world conditions (electrical service quality, vehicle compatibility, network outages, weather, vandalism) may affect performance.
12Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EVFASTCHARGE LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OUR PRODUCTS, SERVICES, OR THE SITE.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS, OUR PRODUCTS, OR OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT.
Some jurisdictions do not allow exclusion or limitation of certain damages, so portions of this section may not apply to you.
13Indemnification
You agree to indemnify and hold harmless EVFastCharge Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your violation of these Terms, (b) your violation of any law or regulation, (c) your misuse of our products or services, or (d) your installation or operation of EV charging equipment in violation of electrical codes or manufacturer instructions.
14Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or our products will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
If you are a consumer (i.e., not a business) located in a jurisdiction with mandatory consumer-protection laws, those laws may apply notwithstanding this section.
Arbitration & class action waiver — TODO before launch
Many U.S. companies require binding arbitration with a class-action waiver. We have not added one here because the choice has significant business and consumer implications. Legal counsel should advise whether to include this clause and in what form.
15Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms on this page and updating the "Effective" date. For significant changes, we may also notify customers by email. Continued use after the effective date constitutes acceptance.
16Severability & entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms (together with the documents they reference: Privacy Policy, Warranty, Returns, Shipping, Accessibility) constitute the entire agreement between you and us regarding our products and services, superseding any prior agreements.
